According to Ukrainian and international legislation, the original creator of any intellectual property object is the author - an individual.

It is the creator who can transfer the temporary or permanent right to use special database and/or dispose of the product. This can be the right to reproduce, distribute, use for commercial purposes - anything that the parties have agreed upon.

Of course, another option is more profitable for business. When a business, which may be, for example, the creator's employer, concentrates full rights to the object, paying the author an appropriate fee.

The most common story from practice. A developer (individual) or a group of such individuals created a design/drawing/technical model of a device. At the same time, he or they worked for a company — that is, on its instructions and in cooperation with it, they created the product. The employer company believes that it is its author. But this is not the case until the copyright of the creator or creators is transferred to it in a documentary form — for example, by concluding an IP agreement.
