Digital preservation: are you compliant with the new 2022 rules?

The provisions of the primary regulatory source in Italy on digitalisation, represented by the Digital Administration Code (CAD), pursuant to Legislative Decree no. 82 of 7 March 2005 and subsequent amendments, and by the related AgID Guidelines regarding electronic documents, electronic signatures and trust services, the reproduction and conservation of documents, electronic communications and digital identities also apply to private companies .

The CAD establishes that books, records and documents whose keeping is mandatory can be created and stored on computer media in compliance with the provisions of this code and according to the AgID Guidelines .






This has also been reaffirmed by art. 2215-bis of the Civil Code , which confirms algeria whatsapp resource that books, records and documentation whose keeping is mandatory by law or regulation or which are required by the nature or size of the business can be created and kept with computer tools, constituting primary and original information from which it is possible to make, on different types of media, reproductions and copies for the uses permitted by law.

Furthermore, pursuant to art. 43 paragraph 3 of the CAD, electronic documents, the conservation of which is prescribed by law or regulation , must be stored in digital form , in compliance with the technical rules established pursuant to article 71 of the CAD, or according to the rules identified by the AgID Guidelines on training, management and conservation which came into force on 10 September 2020 and with mandatory application starting from 1 January 2022.

The obligations to preserve and display the documents that constitute the company's digital archive are considered satisfied for all legal purposes by means of electronic documents , if the procedures used comply with the AGID Guidelines, as prescribed by articles 20 paragraph 5-bis and 43 paragraph 1.
