scans and screenshots
I often see people scanning newspaper articles and putting them on their website or blog. Are they allowed to do that?
No, the scans are unauthorized copies. This also applies if the articles chinese america data are about your own company or person, and also to article images in which you are pictured.
What about screenshots? If someone has taken a screenshot, can it simply be copied?
Screenshots are not "light" images (i.e. not created using radiation technology) and are therefore not protected by copyright. They may therefore be used without asking.
However, this only applies to the screenshots themselves. Whether you are allowed to use their content must be checked separately. If you take a screenshot of someone else's photo, you must therefore check whether this photo may be used, for example on the basis of quotation rights.
Image quotation and "intellectual debate"
If one is intellectually engaging with a painting, is one allowed to use other people's photos of that painting?
In this case, the right to quote must include not only the motif (the painting) but also the photograph. However, this is possible under the current legal situation.
By amending the quotation law, the legislator also allowed the use of other people's works that depict the quoted image (Section 51, Sentence 3 of the Copyright Act). This means that if, for example, you write an interpretation of a painting, you can use other people's photos of that painting.
However, this only applies if you think about the subject in accordance with the instructions above. As already mentioned, you should never use other people's pictures just because they fit the theme.
